Preamble
These Terms of Use (hereinafter "ToU") govern access to and use of the MBC Arena platform (hereinafter "the Platform"), accessible at mbc-arena.com, published by Ma Box de Cross (hereinafter "the Publisher").
MBC Arena is a platform for managing and registering for sports competitions (CrossFit®, Hyrox, Functional Fitness, etc.) connecting sports event organizers and participants.
Use of the Platform implies full and unreserved acceptance of these ToU.
Article 1 - Definitions
Platform : refers to the MBC Arena website and all its features.
User : refers to any person who accesses the Platform, whether registered or not.
Member : refers to any User with an account on the Platform.
Athlete : refers to a Member registered as a participant in competitions.
Organizer : refers to a Member registered as a sports event organizer.
Competition : refers to any sporting event offered on the Platform by an Organizer.
Registration : refers to the act by which an Athlete registers to participate in a Competition.
Article 2 - Purpose
These ToU define the conditions of access and use of the MBC Arena Platform, as well as the rights and obligations of the parties.
The Platform allows:
- Organizers: to create, manage and promote sports competitions
- Athletes: to discover and register for competitions
- All Users: to view rankings and results
Article 3 - Acceptance of ToU
Use of the Platform is subject to prior and unreserved acceptance of these ToU. This acceptance is evidenced by:
- Simple browsing on the Platform for unregistered Users
- The checkbox during registration for Members
The Publisher reserves the right to modify these ToU at any time. Members will be informed of modifications by email and/or notification on the Platform. Continued use after notification constitutes acceptance of the new ToU.
Article 4 - Registration and User Account
4.1 Registration Conditions
Registration is open to any adult natural person or minor with the authorization of their legal representative. The User must provide accurate and complete information during registration.
4.2 Account Types
Two types of accounts are available:
- Athlete Account : allows registration for competitions and viewing results
- Organizer Account : allows creation and management of competitions. Requires verification by the Publisher before activation.
4.3 Account Security
The Member is responsible for the confidentiality of their login credentials. Any use of their account is deemed to have been made by them. In case of suspected fraudulent use, the Member must immediately inform the Publisher at contact@maboxdecross.fr.
4.4 Account Deletion
The Member may request deletion of their account at any time by contacting the Publisher. Deletion results in permanent loss of access to the account and associated data, subject to legal retention obligations.
Article 5 - Services for Athletes
5.1 Competition Registration
The Athlete may register for competitions offered on the Platform. Registration is final once payment is validated. Cancellation and refund conditions are defined by each Organizer.
5.2 Athlete Obligations
The Athlete agrees to:
- Provide accurate information during registration
- Comply with each competition's rules
- Arrive in good physical condition on the day of the event
- Provide required documents (medical certificate, waiver, etc.)
- Respect other participants and organizers
5.3 Liability
The Athlete participates in competitions at their own risk. They acknowledge being informed of the risks inherent in sports practice and declare being in suitable physical condition.
Article 6 - Services for Organizers
6.1 Competition Creation
The verified Organizer may create and publish competitions on the Platform. They are solely responsible for the content of their listings and the proper conduct of their events.
6.2 Organizer Obligations
The Organizer agrees to:
- Provide accurate and complete information about their events
- Comply with regulations applicable to sporting events
- Have necessary insurance
- Ensure participant safety
- Respect their cancellation and refund policy
- Process participant data in accordance with GDPR
6.3 Verification
Organizer accounts are subject to verification by the Publisher before publication of competitions. This verification aims to ensure the seriousness of organizers on the Platform.
6.4 Commission and Payments
Use of the Platform is subject to a commission on paid registrations. Details are available on the Pricing page. Payments are made via Stripe Connect.
Article 7 - User Behavior
All Users are prohibited from:
- Using the Platform for illegal or unauthorized purposes
- Publishing defamatory, insulting, discriminatory or illegal content
- Impersonating a third party
- Collecting personal data from other users
- Attempting to access unauthorized areas of the Platform
- Using automated means to access the Platform
- Disrupting the normal operation of the Platform
Any breach of these obligations may result in suspension or deletion of the account, without prejudice to possible legal action.
Article 8 - Intellectual Property
All elements of the Platform (texts, images, logos, etc.) are protected by intellectual property law and belong to the Publisher or are subject to authorization of use.
Members retain their rights to content they publish but grant the Publisher a non-exclusive, free, worldwide license to use such content within the Platform.
Article 9 - Personal Data
The processing of personal data is detailed in our Privacy Policy.
By using the Platform, the User consents to the collection and processing of their data in accordance with this policy and GDPR.
Article 10 - Publisher Liability
10.1 Intermediary Role
The Publisher acts as a technical intermediary between Organizers and Athletes. It is not the organizer of competitions and cannot be held responsible for their conduct.
10.2 Availability
The Publisher strives to ensure the availability of the Platform but cannot guarantee it. Interruptions for maintenance or updates may occur.
10.3 Limitation
The Publisher's liability can only be engaged in case of proven fault and will be limited to direct and foreseeable damages, excluding any indirect damage.
Article 11 - Termination
The Publisher may suspend or terminate a Member's access to the Platform in case of non-compliance with these ToU, without notice or compensation.
The Member may terminate their account at any time by sending a request to contact@maboxdecross.fr.
Article 12 - Applicable Law and Disputes
These ToU are governed by French law.
In case of dispute, the parties agree to seek an amicable solution before any legal action. Failing this, only French courts shall have jurisdiction.
In accordance with Article L. 612-1 of the French Consumer Code, consumers may use a consumer mediator free of charge for the amicable resolution of a dispute.
