Preamble

These Terms of Sale (hereinafter "ToS") apply to all registrations made on the MBC Arena platform (hereinafter "the Platform").

MBC Arena, published by Ma Box de Cross, is a platform connecting sports competition organizers (hereinafter "Organizers") and participants (hereinafter "Athletes").

Important

Ma Box de Cross acts as a technical and payment intermediary. The sales contract is concluded directly between the Organizer and the Athlete. Each Organizer is responsible for defining their own conditions (rules, cancellation policy, etc.).

Article 1 - Scope

These ToS govern the conditions of sale of registrations for sports competitions via the MBC Arena Platform.

Any registration implies unreserved acceptance of these ToS, as well as the Terms of Use and the specific rules of each competition.

Article 2 - Products and Services

2.1 Nature of Services

The services offered on the Platform consist of registration for sports competitions organized by third parties (Organizers).

Each registration may include:

  • Participation in one or more sporting events
  • Access to facilities on the day of the event
  • Items mentioned by the Organizer (t-shirt, goodies, etc.)

2.2 Competition Description

The essential characteristics of each competition are presented on its dedicated page: date, location, categories, price, rules. The Organizer is solely responsible for the accuracy of this information.

Article 3 - Prices

3.1 Registration Prices

Registration prices are freely set by each Organizer and displayed in euros, all taxes included (incl. VAT). The applicable price is that indicated at the time of order validation.

3.2 Service Fees

In addition to the registration price, service fees may apply. These fees cover the use of the Platform and payment processing costs. The total amount (registration + fees) is clearly indicated before payment validation.

3.3 Promotions

Organizers may offer promotional rates (early bird, promo codes, etc.). These offers are valid under the conditions and deadlines indicated on the competition page.

Article 4 - Order Process

4.1 Order Steps

The registration process is as follows:

  1. Selection of competition and category
  2. Account creation or login
  3. Entering required information
  4. Reading and accepting ToS and rules
  5. Order validation and payment
  6. Email confirmation

4.2 Confirmation

Registration is confirmed only after receipt of full payment. A confirmation email is sent to the address provided during registration.

4.3 Required Documents

Some competitions may require additional documents (medical certificate, liability waiver, etc.). Registration is only final after provision of all required documents.

Article 5 - Payment

5.1 Payment Methods

Payment is made online by credit card (Visa, Mastercard, American Express) via the secure payment solution Stripe.

5.2 Payment Security

Transactions are secured by Stripe, PCI DSS Level 1 certified. Bank details are never stored on our servers. 3D Secure authentication may be required by your bank.

5.3 Billing

A payment receipt is sent by email after each transaction. This document serves as proof of purchase.

Article 6 - Cancellation and Refund

6.1 Cancellation Policy

Each Organizer defines their own cancellation policy, indicated on the competition page. This policy may provide for:

  • A full refund period
  • A partial refund period
  • A no-refund period
  • Processing fees

6.2 Right of Withdrawal

No Right of Withdrawal

In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure services to be provided on a specific date. Registrations for sports competitions are therefore excluded from the right of withdrawal.

6.3 Refund Procedure

To request a refund (if the Organizer's policy allows):

  1. Log in to your MBC Arena account
  2. Go to the "My registrations" section
  3. Select the relevant registration and click "Request a refund"
  4. The request will be processed by the Organizer according to their policy

Refunds are made to the original payment method, usually within 5-10 business days after validation.

6.4 Cancellation by Organizer

In case of cancellation of the competition by the Organizer, they commit to fully refund registrations. Ma Box de Cross cannot be held responsible for cancellations decided by Organizers.

Article 7 - Registration Transfer

Transfer of registration to a third party may be authorized by the Organizer under their own conditions. The terms (deadline, possible fees) are specified in each competition's rules.

To request a transfer, contact the Organizer directly via the Platform messaging or the contact details provided.

Article 8 - Responsibilities

8.1 Ma Box de Cross Responsibility

Ma Box de Cross acts as a technical intermediary and is not a party to the sales contract between the Organizer and the Athlete.

Ma Box de Cross cannot be held responsible for:

  • The content of listings published by Organizers
  • The cancellation or modification of a competition
  • The conduct of the event
  • Damages suffered during a competition
  • The Organizer's failure to meet their obligations

8.2 Organizer Responsibility

The Organizer is solely responsible for organizing and conducting their competition properly, including:

  • The accuracy of published information
  • Compliance with applicable regulations
  • Participant safety
  • Mandatory insurance
  • Processing refund requests

8.3 Athlete Responsibility

The Athlete participates at their own risk and must ensure they are in suitable physical condition. They must comply with competition rules and safety instructions.

Article 9 - Claims and Disputes

9.1 Complaints

For any complaint regarding a registration:

  • Competition-related issue (conduct, cancellation, refund): contact the Organizer directly
  • Technical issue (payment, account access, bug): contact Ma Box de Cross at contact@maboxdecross.fr

9.2 Mediation

In accordance with Articles L. 611-1 et seq. of the French Consumer Code, in case of unresolved dispute, you may use the consumer mediation service free of charge.

The mediator may be contacted within one year of the written complaint to the professional.

Article 10 - Force Majeure

Neither Ma Box de Cross nor the Organizer may be held liable for failure to perform their obligations in case of force majeure, including: natural disasters, epidemics, government decisions, strikes, major technical failures.

In case of force majeure preventing a competition from being held, the Organizer will determine the terms of postponement or refund.

Article 11 - Personal Data

Data collected during registration is necessary for order processing and is transmitted to the relevant Organizer for event management.

Article 12 - Applicable Law

These ToS are governed by French law.

In case of dispute and after failure of an attempt at amicable resolution, only French courts shall have jurisdiction.
